These Terms of Service ("Terms") govern your use of thoughtstream.us (the "Service"), operated by Centricle LLC ("we," "us," or "our"). By using the Service, you agree to these Terms.
1. The Service
Thoughtstream is a voice-powered idea capture tool. The Service allows you to capture, store, and retrieve thoughts via the web interface or through integrations such as Siri Shortcuts. Thoughts are stored in your personal account and are private by default.
2. Intellectual Property
The Service, including its design, code, and branding, is owned by Centricle LLC and protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. This license does not include the right to copy, modify, distribute, or reverse-engineer any part of the Service.
3. User Representations
By using the Service, you represent and warrant that:
- You are at least 18 years old
- The information you provide is accurate and complete
- You will not use the Service for any unlawful purpose
- Your use will comply with all applicable laws and regulations
4. Prohibited Activities
You agree not to:
- Scrape, crawl, or automatically extract data from the Service
- Attempt to gain unauthorized access to any part of the Service
- Upload malicious code or interfere with the Service's operation
- Impersonate another person or entity
- Use the Service to harass, abuse, or harm others
- Circumvent any security features of the Service
- Use the Service in a way that could damage, disable, or overburden our infrastructure
- Share or misuse API keys to grant unauthorized access
5. Your Content
"Your Content" means the thoughts you capture using the Service, whether entered via the web interface or through API integrations (such as Siri Shortcuts). Your Content is private to your account.
6. Content License
You retain all ownership rights to Your Content. By using the Service, you grant us a limited license to store, process, and display Your Content solely for the purpose of providing the Service to you. We do not claim ownership of your thought data, and we will not use it for purposes unrelated to operating the Service.
7. API Access
The Service provides an API for programmatic access, including integration with Siri Shortcuts. You are responsible for keeping your API key secure. API keys grant full access to your thought data. If you believe your key has been compromised, regenerate it immediately in your account settings.
8. Service Management
We reserve the right to monitor the Service for violations of these Terms, take appropriate legal action against violators, restrict or disable access to the Service at our sole discretion, and remove content that is excessive in size or burdensome to our systems.
9. Termination
We may suspend or terminate your account at any time for violations of these Terms. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately, and we may delete your data in accordance with our Privacy Policy.
10. Modifications
We reserve the right to modify or discontinue the Service (or any part of it) at any time without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict-of-law principles.
12. Dispute Resolution
If you have a dispute with us, you agree to first try to resolve it informally by contacting us. If we cannot resolve the dispute within 30 days, either party may pursue binding arbitration in the State of Maryland. You agree to resolve disputes on an individual basis and waive any right to participate in a class action.
13. Disclaimer
THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that the Service will be uninterrupted, error-free, or secure. Siri integration depends on Apple's Shortcuts framework and may be affected by changes outside our control.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CENTRICLE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).
15. Indemnification
You agree to indemnify and hold harmless Centricle LLC from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
16. User Data
We maintain backups of data stored on the Service, but we are not responsible for data loss. You are responsible for maintaining your own backups of any data that is important to you. Our data practices are described in our Privacy Policy.
